Introduction

This privacy statement applies to the processing of personal data by Ternair, which includes the following entities: 2holdMore B.V (KvK: 30 20 71 17), Ternair Software Solutions B.V. (KvK: 30 27 39 83) and 2bMore B.V. (KvK: 30 23 4 431). Hereafter collectively referred to as "Ternair", "we" or "us". Ternair processes personal data of its (potential) customers and partners. We do this in order to help our (potential) customers in the best possible way and to achieve our objectives. The basic principle here is that Ternair will not process more personal data than necessary for the purposes described below. In this privacy statement we will explain why and how we process your personal data.

Who is Ternair

Ternair develops and delivers marketing automation solutions and services for medium-sized and large organizations that want to get more out of their customer data by applying it in an effective and efficient way in 1-on-1 interactions with their target groups. With Ternair, we offer marketing professionals an advanced and user-friendly solution for setting up and automating data-driven 1-to-1 campaigns for all channels and touchpoints.

Personal Data

Ternair processes your personal data because you use our products, services and/or because you provide this data to us yourself. When you subscribe to the newsletter and/or request information, demonstrations, quotations, etc. we ask you to enter your personal and company data. This data can be combined with previously obtained data from other Ternair services and/or request forms. We use cookies and other technologies to get an impression of your activities within our websites, e-mailings and services in order to provide you with an optimal experience. Read more about cookies in our cookie statement. The personal data we may process are:

  • First and last name

  • Address, place of residence

  • Telephone number

  • E-mail address, opt-in for emailings

  • Gender

  • Company

  • Function

  • Participation details (including. trainings/ webinars/ events)

  • Contact history

  • Internet browser and device type

  • Date, time, location, internet session duration

  • If you receive emails from us, we record your interactions (opening and clicking behavior)

  • Other personal information that you actively provide such as by signing up for the newsletter, in correspondence and by telephone

When you send e-mail or other communications to us, we may retain those communications. Sometimes we ask for your personal information relevant to the situation at hand. This allows us to process your questions and respond to your requests.

Special and or sensitive company information

Our website and/or service does not intend to collect information about website visitors who are under the age of 16. Unless they have parental or guardian consent. However, we cannot verify whether a visitor is older than 16. Therefore, we encourage parents to be involved in their children's online activities in order to avoid collecting information about children without parental consent. If you believe that we have collected personal information about a minor without such consent, please contact us at marketing@ternair.com and we will delete this information.

Purposes of processing

Ternair processes your personal data for the following purposes:

  • To comply with legal obligations (administration, storage and tax obligations).

  • To provide products and services that you have purchased.

  • To handle your registration and/or payment after you have purchased a product or service.

  • To contact you via e-mail or phone to answer your (support) questions or contact/price/demo request.

  • To create an account for you after you have registered yourself.

  • To inform you about (changes/ software updates of) our services and products that you have previously purchased.

  • To inform you about other products or services offered by Ternair.

  • To send invitations to participate in surveys, trainings or events related to Ternair's product and service offerings.

  • To send (personalized) newsletters and e-mailings to which you have subscribed. Each newsletter contains an unsubscribe option

  • To communicate with you through various channels (phone, mail, email, social media, website, within our software) from both a service and marketing standpoint.

  • To improve our website based on your browsing habits and to tailor our range of products and services to your preferences. We only do this with your permission.

Automated decision making and profiling

Ternair does not use automated decision making and/or profiling. These are decisions that are made by computer programs or systems, without an employee of Ternair sitting in between.

Bases of processing

Ternair processes your data for:

  • Performing a legal obligation.

  • Concluding or performing a contract.

  • With your consent.

  • Executing the legitimate (marketing) interest: to provide the service you ask for, to get to know our (potential) customers better, and to tailor our offer to the needs of our target audience.

Retention periods

Ternair will not keep your personal data longer than strictly necessary. The retention period depends on the purpose for which we obtained or collected the data and any legal obligations to retain data. If you have any questions about this, please contact marketing@ternair.com.

Sharing personal data with third parties

Ternair never provides, sells, rents or leases your personal data to third parties, unless we are legally obliged to provide data, it is necessary for the performance of an agreement or if you have given your consent. We engage service providers to perform our services. These are not 'third party recipients' but 'processors'. These processors do not use the data for their own purposes and only process the personal data in accordance with Ternair's instructions. We conclude a processing agreement with the companies that process your data to ensure the same level of security and confidentiality of your data. Ternair remains responsible for these processing operations.

Data within the EEA

Your personal data will only be processed within the European Economic Area (EEA).

Security

Ternair takes the protection of your data seriously and implements appropriate organizational and technical measures to protect against misuse, loss, unauthorized access, unwanted disclosure and unauthorized alteration.To protect your personal data, we have taken, among other things, the following measures:

  • Ternair has officially received the DDMA Privacy Guarantee label. With this quality mark we demonstrate that we use personal data in a careful and transparent manner, that we deal correctly with personal data that (may) be used for advertising purposes, and that we act in accordance with all applicable privacy regulations. On the basis of enforcement regulations, the DDMA assesses whether we neatly adhere to the strict rules and legal obligations.

  • Our website and software has an SSL certificate which gives visitors and users the guarantee that (personal) data are sent through browsers via HTTPS, which encrypts and secures information.

  • Our software is tested annually for vulnerabilities by independent and accredited parties who perform penetration tests (or pen tests). The conclusion so far has always been that our software is sufficiently adequately secured to be resilient against digital attacks.

  • Ternair has taken extensive measures that cover what the procedure is in the event of a data breach. But more importantly; various technical and organizational measures have been taken to prevent data breaches.

  • Servers and devices of our employees are equipped with up-to-date security software, such as a virus scanner and firewall. The server is hosted by Sentia in Belgium.

Ternair's website contains a number of links to other websites. Ternair is not responsible for how those organizations process personal data. We recommend that you read the privacy and cookie statement of the organization in question.

Social media

To give our content more atmosphere and to report on our events and meetings we use social media, such as Facebook, Instagram, Twitter and LinkedIn. For this purpose, we may post images of event attendees, speakers and other individuals on our social media pages. If you prefer not to have us post footage of you on social media please contact us at marketing@ternair.com. The use of images by social media is subject to the privacy statement of the relevant social media platform.

Rights of data subjects

Ternair looks after all your privacy rights.

Information and inspection

You have the right to information and inspection of the personal data we process about you. We are happy to tell you how and why we process that data.

Rectification

You have the right to have your data changed if the data is not correct (any longer). Do you feel that we have incorrect data about you? Please let us know and we will correct it.

Emergency

You have the right to ask us to delete the personal data we hold about you. We may not be able to delete your personal data completely because we still need to process some of it for other purposes. For example, administration or other legal obligations.

Restriction

If you feel that we are processing your personal data unlawfully or inaccurately, you can also have that processing restricted.

Objection (opposition)

You have the right to object to the processing of your personal data. If you object to the use of your personal data to inform you about our activities and similar ("direct marketing") processing, we always honor this. You can prevent further receipt of (marketing) emails from Ternair by clicking the unsubscribe link in every email you receive from us. Your data will then no longer be used for direct marketing purposes. If you object to other forms of processing of your personal data, we will assess whether we can accommodate your objection.

Transferability

You have the right to transfer your personal data. This means that you can make a request to us to send the personal data we hold about you in a common file format to you or another organization named by you.

Withdraw consent

You have the right to withdraw any consent you may have for data processing. For example, to receive e-mailings.

Exercise of rights

You can exercise your rights by contacting marketing@ternair.com. To ensure that the request is made by you, we ask that you send a copy of your ID with the request. In this copy, black out your passport photo, MRZ (machine readable zone, the strip of numbers at the bottom of the passport), passport number and Citizen Service Number (BSN). This is to protect your privacy. We will respond to your request as quickly as possible, but within four weeks.

Supervisor

Ternair would like to remind you that you have the opportunity to file a complaint with the national supervisor, the Personal Data Authority (AP), via this form.

Cookies

On Ternair's website, we use cookies and similar techniques such as scripts, tags, fingerprints and measurement and conversion pixels (hereinafter collectively referred to as "cookies"). We use cookies for the functionality, quality and effectiveness of our website, email marketing and other digital channels. We also provide a personalized and relevant (customer) experience when you give your consent. For example, by using cookies we ensure that:

  • Surfing on Ternair is more fun and easier;

  • We can measure how our website is being used and where we can improve it further;

  • We can show relevant and tailored content within our website, email campaigns and other digital channels;

What are cookies?

These cookies are also used to store your preferences, such as language settings. It is not possible to opt out of functional cookies.

Analytical cookies - anonymous

In order to optimize the quality and effectiveness of our website, Ternair uses analytical cookies. Using Google Analytics, we collect anonymized data about the use of our website. This includes the number of visitors, the duration of the visits and the order of the visited pages's. In this way we gain insight into how the websites are used and on the basis of this data we can make adjustments if necessary. Google Analytics only takes care of the placement of the cookies and the research and analysis of the resulting information. Although IP addresses are processed when using these analysis cookies, we have taken a number of measures to ensure your privacy. For example, we have entered into a processor agreement with Google Analytics. It follows from this that Google only acts as a processor of the data collected via the cookies. Google therefore has no independent right with respect to this data and may not, for example, use this data for its own purposes. We have deactivated the "data sharing" function within Google Analytics. In addition, we have chosen to make the last octet of the IP address invisible. Analytical cookies are not used for any purpose other than improving the website. Statistics and other reports cannot be traced back to individuals. Since we only use anonymous analytical cookies, these cookies are considered functional cookies.

Marketing cookies

Only if you have given your prior consent, Ternair uses marketing cookies to deliver interesting and customized content and/or advertisements to you. We distinguish between two types of marketing cookies.

Marketing cookies (own) - within Ternair's website

Ternair uses marketing cookies to provide you with relevant content within its own website, email campaigns and other digital channels. Using a "fingerprint" we collect information about how you visit our websites, such as click behavior and pages visited, and combine this (if possible) with your (customer) data in our customer systems. Based on this information, we can better tailor our content and advertisements through our website, email and other digital channels to your (customer) relationship, preferences, profile and expectations. Unlike third-party marketing cookies, these cookies cannot track browsing behavior across multiple websites. Only we can read these cookies.

Marketing cookies (third parties) - inside and outside of Ternair's website

In addition to our own cookies, there are also marketing cookies that are not placed or read by ourselves, but by third parties engaged by us that may offer functionalities on the websites. This means that information about you collected by the third-party cookies is shared with the relevant third party. These include (social networking) platforms such as Facebook, Instagram, Linkedin and Twitter. Ternair uses these marketing cookies to show you relevant ads. Using "pixels" third parties collect information about your surfing behavior across multiple websites. Among other things, they perform the following functions: they prevent the same ad from recurring continuously, they ensure that ads are displayed correctly for advertisers, and in some cases they select ads based on your interests. The (algorithm of the) ad network ultimately determines when a Ternair ad is shown. In some cases, the networks use (derived) information about your behavior and characteristics to generate similar target groups for Ternair. We also use this technique to exclude you from a campaign when it is not relevant to you, for example, because you already use the product to which the ad relates. Even if you do not accept cookies, you may still encounter ads from us online. Not all of our ads use cookies. However, cookies allow us to show you ads that are relevant to you. We have no control over the collection or further use of your information by third parties. Unforeseen cookies

Because of the way our website works, we may not be able to understand in all cases the cookies that are placed on our website. This can occur, for example, in case so-called embedded elements (texts, images, videos and/or documents stored by another party) are used.

Blocking and/or deleting cookies
